Unemployment Insurance Amendments

This bill:  reduces the maximum unemployment insurance contribution rate for an employer from 9% plus the social contribution rate to 7% plus the social contribution rate beginning in calendar year 2012; caps the social unemployment insurance contribution rate for all employers at .4% for calendar year 2012 only; provides that if the reserve fund is insolvent, the reserve factor is 2.0 until the reserve fund becomes solvent; and makes technical changes.

Electronic Personal Medical Records

This bill:  amends the duties of the state Medicaid plan to enroll Medicaid beneficiaries in the electronic exchange of clinical health records unless the individual opts out; requires the Department of Health to submit a waiver for the state Medicaid plan and Children's Health Insurance Program to require beneficiaries to enroll in the electronic exchange of clinical health records; amends the duties of the Children's Health Insurance Program to enroll the members of the Children's Health Insurance Program in the electronic exchange of clinical health records unless the individual opts out; and amends the duties of the Public Employees Health Program to require the program to enroll members in the electronic exchange of clinical health records.

This bill: defines terms; requires an ambulatory surgical facility, a general acute hospital, and a specialty hospital to share with the Department of Health data on health care associated infections that the facility submits to the National Healthcare Safety Network in the Centers for Disease Control and Prevention pursuant to requirements of the Center or Medicare and Medicaid Services; requires the Department of Health to prepare and publicly disclose a report on health care associated infection rates; establishes a protocol for the creation of the report; permits the report of health care associated infections to include data that compares and identifies facilities; states that the report shall not be used as evidence in a criminal, civil, or administrative proceeding; and makes technical changes.

Waste Tire Amendments

This bill:

  • modifies the definition of "waste tire";
  • prohibits a tire retailer from transferring ownership of a waste tire to anyone other than a waste tire transporter or a person who purchases it for the person's own use;
  • prohibits a recycler from receiving partial reimbursement for baling whole waste tires or materials derived from waste tires that are larger than shredded tires;
  • deletes references to the Waste Tire Recycling Industrial Assistance Loan Program and the Waste Tire Recycling Industrial Assistance Loan Fund; and

Green Schools Joint Resolution

This resolution:

  • encourages the Utah State Board of Education to consider the broader application of the design and construction practices for green schools, both for new construction and major renovation projects undertaken with school district funds; and encourages school districts to consider seeking application for certification of green schools under the United States Green Building Council's Leadership in Energy and Environmental Design rating system (LEED), or certification under a comparable system with requirements at least equivalent to the LEED Silver certification for new or retrofit construction, or other building performance systems like the United States Department of Energy's ENERGY STAR Program.

  • establishes qualifications for board members;
  • requires board members to comply with attendance standards and conflict of interest procedures;

Driver License & ID Card Amend

This bill:

  • repeals the requirement that a peace officer take a motor vehicle operator's Utah license certificate or permit and issue a temporary license certificate effective for only 29 days from the date of arrest if the operator of the vehicle has been arrested for certain alcohol or drug related offenses;
  • repeals the provision that prohibits the state from participating in the implementation on the REAL ID Act and provides that the Driver License Division may implement the REAL ID Act;
  • prohibits a person from holding both an unexpired Utah license certificate and an unexpired Utah identification card;
  • provides that if certain persons hold an unexpired Utah license certificate and an unexpired Utah identification card, the person shall surrender either the Utah license certificate or the Utah identification card within certain time frames, or the Driver License Division shall cancel the person's Utah identification card;
  • provides that certain limited-term license certificates or identification cards expire on the date of issuance in the first year following the year that the limited-term license certificate or identification card was issued;
  • authorizes the Driver License Division to extend certain license certificates by electronic means or other means determined by the division; and makes technical changes.

Production and Sale of Food in UT Revisions

This bill:

  • prohibits federal regulation of an agricultural product that remains in Utah after it is made, grown, or produced in Utah;
  • allows a person to identify certain agricultural products by indicating that they are "Made in Utah," "Grown in Utah," or "Produced in Utah";
  • prohibits a person from claiming that an agricultural product was made, grown, or produced in Utah if the product is not a Utah agricultural product;
  • makes it a class A misdemeanor for a person to enforce federal regulation of a Utah agricultural product that remains in Utah; and
  • provides a person grounds to request injunctive relief if the person is punished in violation of this section.

This bill:

  • prohibits a tanning facility from allowing use of its tanning device unless the facility meets specified requirements;
